Terms of sale and use
These terms cover the use of mycaloriesfeedback.com and the sale of the MyCaloriesFeedback subscription purchased on the web. They apply to consumers and to professionals.

Two sales channels, two sets of rules
This is the key point of the document: depending on where the subscription is purchased, the seller is not the same.
- Subscription purchased on the web, by card through Stripe: the seller is Didier Rubin, the publisher of the app. These terms apply, and didier.rubin97@gmail.com is the address to write to.
- Subscription purchased inside the Android app, through Google Play: the seller is Google. Google Play's terms apply, and cancellation as well as refunds are handled from your Google account, in the «Subscriptions» section of Google Play.
Stripe Payments Europe processes web payments. The publisher never receives or stores your card number.
What you buy, and the price
The subscription unlocks the Premium features of the app, including meal analyses with no daily limit, personal targets, history and favorite meals.
- A trial of 7 days first, limited to 7 photos per day.
- After the trial, a yearly subscription of €29.99 per year. That is the total amount payable. VAT not applicable, article 293 B of the French General Tax Code: no tax is added to the displayed price.
- The commitment runs for twelve months and renews automatically from year to year.
- The price may change for the future; any change is announced before renewal and never applied to a period already paid for.
Right of withdrawal
A consumer customer has 14 days from the conclusion of the contract to withdraw, with no reason to give and no penalty.
To use that right, a plain e-mail to didier.rubin97@gmail.com is enough: give the account address and the purchase date. No specific form is required. The refund is issued within 14 days of receiving the request, using the same payment method.
Because this is digital content supplied immediately, a customer who asks to start using the service before the end of the 14 days expressly waives the right of withdrawal for the part of the service already delivered. That request for immediate access and that waiver are collected at payment time, through a separate checkbox.
For a subscription bought through Google Play, the request follows Google's refund rules.
Renewal and cancellation
French law requires the publisher to remind you before the subscription renews: you receive an e-mail at the latest one month before the deadline for stopping the renewal, and you can then cancel free of charge.
Cancellation is possible at any time, directly online from your account: no letter, no phone call, no justification. It takes effect at the end of the period already paid for, which stays available until its term.
For a Google Play subscription, cancel from the subscriptions section of your Google account.
Consumer mediation
If something goes wrong, write to didier.rubin97@gmail.com first: most situations are settled that way.
Under articles L611-1 and following of the French Consumer Code, you may refer the case free of charge to a consumer mediator for the amicable settlement of a dispute between you and the publisher. The publisher has appointed CM2C — Centre de la Médiation de la Consommation de Conciliateurs de justice, 49 rue de Ponthieu, 75008 Paris — www.cm2c.net.
Mediation is only possible after you have tried to settle the dispute directly with the publisher through a written complaint. You keep the right to bring the matter before the competent court.

Using the site
Browsing the site is free; connection costs are yours. The site does not let you create an account or enter personal data: it presents the app and links to it.
The site's content — text, images, screenshots, logo, code — is protected by copyright. Reproducing or reusing it without written permission is prohibited.
Liability
The publisher works to keep the service available and its information accurate, without guaranteeing uninterrupted or error-free operation. Nutrition analyses produced by the artificial intelligence are estimates.
The site links to third-party services, in particular Google Play. The publisher has no control over their content and accepts no liability for it.
Governing law
These terms are governed by French law. This does not remove the protections granted to a consumer by the mandatory law of their country of residence in the European Union.
Changes to these terms
The publisher may change these terms at any time. The version that applies to a subscription is the one accepted at payment time; the version in force for the site is the one published on this page.
